1. About these Terms

These Terms and Conditions (the "Terms") govern your access to and use of www.tempoperme.net (the "Site") and your purchase of any goods from the Site.

The Site is owned and operated by Carmela Triulcio ("we", "us", "our"), trading as TempoPerMe (ABN 47 923 383 755), of 14 Marks Street, Coburg, Victoria, Australia.

By using the Site, browsing our products, creating an account or placing an order, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years of age to purchase from this Site, or be using the Site under the supervision of a parent or guardian. By placing an order you confirm that you meet this requirement.

We do not knowingly collect personal information from children under 16. See our Privacy Policy for details.

3. Our products

We sell handmade and hand-finished soap, candles, body products and related accessories.

Because our products are handmade in small batches, there may be minor variations in colour, scent strength, size, finish and appearance between items and from the photographs on the Site. These variations are a normal characteristic of handmade goods and are not defects.

We take care to make all product descriptions, ingredient lists, images and other information on the Site as accurate as possible. Colours may also display differently depending on your screen.

4. Safety, allergies and intended use

Our products are cosmetic and decorative goods intended for ordinary personal use. They are not medicines and are not intended to diagnose, treat, cure or prevent any illness or condition.

You are responsible for reading the ingredient list for each product before purchasing and using it. If you have known sensitivities or allergies, please check the ingredients carefully and patch test before full use. Stop using a product and seek medical advice if you experience irritation or an adverse reaction.

Candles must be used according to the safety directions supplied with the product. Never leave a burning candle unattended, keep it away from children, pets, draughts and anything flammable, and place it on a heat-resistant surface.

5. Prices and availability

All prices are shown in Australian dollars (AUD). We are not registered for GST, so no GST is included in or added to our prices. Delivery charges are additional and are calculated and displayed at checkout before you confirm your order.

Prices and product availability may change at any time without notice. Products listed as out of stock are still governed by these Terms.

Despite our best efforts, a small number of products on the Site may be incorrectly priced or described. If we discover an error in the price or description of a product you have ordered, we will contact you as soon as possible to let you know and give you the option of continuing with the corrected order or cancelling it for a full refund.

6. Orders and acceptance

When you place an order you are making an offer to purchase the goods in that order. Your order is accepted, and a contract formed between us, only when we send you an email confirming that your order has been dispatched.

We may refuse, cancel or limit an order where:

  • the product is out of stock or no longer available;

  • there has been a pricing or description error;

  • we are unable to obtain authorisation for your payment;

  • we suspect the order is fraudulent or in breach of these Terms; or

  • we are unable to deliver to the address supplied.

If we cancel an order after you have paid, we will refund the full amount you paid to the original payment method.

7. Payment

We accept credit card, debit card and direct debit through our secure payment provider.

By submitting your payment details you confirm that you are authorised to use the payment method and you authorise us (through our payment provider) to charge the total order amount, including delivery.

We do not store your full card details on our systems. Payment details are handled by our payment provider under their own security standards.

If we believe a payment is fraudulent or breaches these Terms or the law, we may cancel or reverse the transaction and cancel the related order.

8. Delivery

We deliver within Australia. Orders are usually dispatched within 1–3 business days of payment clearing, and delivery typically takes a further 3–5 business days after dispatch.

Delivery time frames are estimates only and do not include weekends or public holidays. They may be affected by carrier delays, weather, peak periods and other circumstances outside our control. We are not liable for delays caused by the carrier once the goods have been dispatched.

Delivery charges are payable in addition to the price of the goods and are shown at checkout.

You are responsible for providing a complete and accurate delivery address and recipient name. We are not liable for goods delivered to the wrong address or wrong person where you have given us incorrect or incomplete details, and re-delivery in those circumstances will be at your cost.

Risk in the goods passes to you on delivery to the address you supplied.

Please note: during hot weather, soaps, balms and candles can soften or sweat in transit. This is a normal property of natural waxes, butters and oils and is not a fault in the product.

9. Returns and refunds

Our Return and Refund Policy forms part of these Terms. Please read it before purchasing.

Nothing in these Terms or in our Return and Refund Policy excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law.

10. Your account

If you create an account on the Site, you agree that:

  1. you are responsible for keeping your login details and password secure, and for all activity that occurs under your account;

  2. the information you give us is accurate, current and truthful, and you will keep it up to date; and

  3. you will notify us promptly if you believe your account has been accessed without your authorisation.

We may suspend or close your account if you use the Site unlawfully or breach these Terms.

11. Reviews and comments

Where the Site allows you to post public comments or product reviews, you agree not to post anything that is unlawful, misleading, defamatory, abusive, obscene, infringing of someone else's rights, or that contains spam or another person's private information.

You keep ownership of what you post, but you grant us a non-exclusive, royalty-free licence to use, display, reproduce and adapt that content in connection with the Site and our marketing. We may remove any posted content at our discretion.

12. Intellectual property

All content on the Site — including images, photographs, text, product descriptions, logos, branding, layout and downloadable files — is owned by or licensed to Carmela Triulcio and is protected by Australian and international copyright and trade mark law.

You may view and print content for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute or commercially exploit any part of the Site without our prior written permission.

13. Acceptable use

You agree not to use the Site:

  • for any unlawful purpose or in breach of these Terms;

  • to interfere with or disrupt the Site, its servers or its security;

  • to scrape, harvest or extract data from the Site by automated means; or

  • to resell our products commercially without our written consent.

14. Links to other websites

The Site may contain links to third party websites and services that we do not own or control. We are not responsible for the content, policies or practices of those third parties. You should read their terms and privacy policies before using them.

15. Availability of the Site

We aim to keep the Site available at all times but do not guarantee uninterrupted access. The Site may be unavailable during maintenance, updates or events outside our control. We may change, suspend or discontinue any part of the Site at any time.

16. Limitation of liability

To the maximum extent permitted by law, and subject to clause 17:

  • we are not liable for any indirect, incidental, special or consequential loss, or any loss of profits, revenue, data or goodwill, arising out of your use of the Site or your purchase of goods from us; and

  • our total liability to you for any claim in connection with a product is limited, at our option, to replacing the product, supplying an equivalent product, or refunding the price you paid for it.

Nothing in this clause limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence.

17. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Where any consumer protection legislation applies and cannot be excluded, these Terms are read subject to that legislation, and where there is a conflict, the legislation prevails.

18. Indemnity

Except where prohibited by law, you indemnify Carmela Triulcio and her agents and contractors against any claims, losses, damages, liabilities and expenses (including reasonable legal costs) arising from your misuse of the Site, your breach of these Terms, or your breach of any law or the rights of a third party.

19. Privacy

We handle your personal information in accordance with our Privacy Policy, which forms part of these Terms and is available on the Site.

20. Governing law

These Terms are governed by the laws of the State of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts able to hear appeals from them.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

22. Changes to these Terms

We may amend these Terms from time to time to reflect changes in the law or in how we operate the Site. The updated version applies from the date it is published on the Site, and we will update the "Last updated" date above. The Terms that apply to your order are the Terms in force at the time you placed it.
